This website is operated by MASSA LEGACY LLC under the trade name The Tennant Sisters. Throughout the site, “we”, “us”, and “our” refer to MASSA LEGACY LLC trading as The Tennant Sisters.

These Terms of Service govern your use of https://thetennant-sisters.com and purchases made through the website. By accessing the website or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and Payment Policy.

Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, including rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986.

2. ONLINE STORE TERMS

You must be legally capable of entering into a binding contract, or have the permission of a parent or legal guardian where applicable. You may not use the website or products for an unlawful purpose, interfere with the website, introduce malicious code, or violate the rights of another person.

3. PRODUCT INFORMATION

We aim to describe our clothing, footwear, and accessories accurately and display product colours, sizes, materials, and images as faithfully as reasonably possible. Screen settings and production variations may cause minor differences. Any material difference remains subject to your rights under applicable law.

Please review product measurements and descriptions before ordering. Product availability may change without notice.

4. PRICES, GST, AND PAYMENT

Prices are shown in New Zealand dollars (NZD). Applicable GST is included or collected as required by law. Payment methods available for an order are displayed at checkout.

We may correct an obvious pricing or description error before accepting an order. If an error affects an order already placed, we will contact you and offer the choice required by law, which may include confirming the corrected order or receiving a refund.

5. ORDERS AND CONTRACT FORMATION

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. We may refuse or cancel an order for a legitimate reason, including unavailable stock, failed payment authorisation, suspected fraud, an obvious error, or a shipping address outside New Zealand.

If we cancel an order after capturing payment, we will refund the relevant amount to the original payment method.

6. SHIPPING AND DELIVERY

Products are dispatched from our international fulfilment partner in Ningbo, China. Processing normally takes 1–3 business days, and transit after dispatch normally takes 7–14 business days. The estimated total delivery time is 8–17 business days.

Final delivery in New Zealand is normally handled by NZ Post. International logistics partners may transport the parcel before it reaches the local carrier network. Standard shipping within New Zealand is free.

Full details are set out in our Shipping Policy. The seller remains responsible for providing the remedy required by law where goods are not delivered within the promised or a reasonable time.

7. IMPORT CHARGES

Applicable GST is included or collected as required by law. The Tennant Sisters pays the customs duties, import taxes, brokerage fees, and import-clearance charges connected with a properly processed shipment. If a carrier unexpectedly requests payment, contact us before paying.

8. CUSTOMER-SUPPLIED INFORMATION

You must provide current, complete, and accurate billing, contact, and delivery information. We are not responsible for a delivery failure caused by an incorrect or incomplete address supplied by you, but we will reasonably assist with a carrier investigation. If you refuse or do not accept delivery, or the parcel is returned because of an incorrect address or failure to collect it, you must pay the reasonable reshipping cost before we send the order again. This does not apply where the failed or refused delivery resulted from damaged or incorrect goods or another failure attributable to us.

9. CANCELLATIONS AND ORDER CHANGES

You may request a cancellation or edit within 2 hours after placing the order. The request can be approved only if processing has not started. Once processing has started or the order has been dispatched, it cannot be cancelled or edited, but it may qualify for return after delivery under our Return & Refund Policy.

This section does not limit any cancellation right that cannot lawfully be excluded.

10. RETURNS, REFUNDS, AND CONSUMER GUARANTEES

We offer a voluntary 30-day return period beginning on delivery. For change-of-mind returns or customer ordering errors, the customer pays the direct return cost. If we supply an incorrect item, size, or colour, or the product is damaged or defective, we cover reasonable return costs and provide the remedy required by New Zealand law.

Consumer products must meet the guarantees imposed by the Consumer Guarantees Act 1993, including acceptable quality, fitness for purpose, correspondence with description, and delivery within a reasonable time. Depending on the failure, available remedies may include repair, replacement, refund, reimbursement of reasonable costs, or compensation. Our Return & Refund Policy does not replace or reduce these rights.

11. OPTIONAL THIRD-PARTY SERVICES AND LINKS

The website may contain third-party tools, payment options, integrations, or links. Third-party services are governed by their own terms and privacy practices. We are not responsible for an external website that we do not control, but this does not limit responsibility that the law places on us for the services we choose to use in fulfilling your order.

12. CUSTOMER CONTENT AND REVIEWS

If you submit a review, image, suggestion, or other content, you confirm that you have the right to provide it and that it is not unlawful, misleading, abusive, defamatory, or infringing. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for operating and promoting the store, subject to applicable privacy and consumer law.

We may moderate or remove content where reasonably necessary. We will not manipulate reviews or represent fabricated reviews as genuine.

13. INTELLECTUAL PROPERTY

The website, branding, text, graphics, and other content owned or licensed by us are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, sell, or exploit protected content without permission, except as permitted by law.

To the maximum extent permitted by law, neither party is liable for loss that was not reasonably foreseeable or was not caused by that party’s breach. We do not exclude liability for fraud, wilful misconduct, or any statutory consumer right, guarantee, remedy, or liability that cannot lawfully be excluded or limited.

17. INDEMNITY

You are responsible for loss reasonably resulting from your unlawful use of the website or material breach of these Terms. This section does not require a consumer to indemnify us for our own breach, negligence, unlawful conduct, or failure to meet a statutory guarantee.

18. SEVERABILITY

If any provision is held unlawful or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

19. TERMINATION

We may suspend or terminate website access where a user materially breaches these Terms or creates a security or legal risk. Rights and obligations that arose before termination remain unaffected.

20. GOVERNING LAW

These Terms are governed by the laws of New Zealand in relation to sales to New Zealand consumers, without excluding any mandatory rights available to you. You may use the courts or dispute-resolution processes available under applicable law.

21. CHANGES TO THESE TERMS

We may update these Terms for legal, operational, or service-related reasons. The current version will be posted on this page with its effective date. Changes do not retroactively reduce rights attached to an order already accepted.
